Terms of Service

These Terms of Service ("Terms") govern your use of the CarWashPilot platform (carwashpilot.com), operated by Altin Etemaj, Lessingstraße 4b, 25335 Elmshorn, Germany ("we", "us", "our"). By registering for or using CarWashPilot, you agree to these Terms. These Terms apply in conjunction with our Privacy Policy.

Service Description

CarWashPilot is a Software-as-a-Service (SaaS) platform that enables car wash businesses to manage online bookings and scheduling, customer management (CRM), subscriptions, payment processing via Stripe Connect, and real-time dashboard and analytics. We provide the technology platform; we do not provide car wash services directly. We reserve the right to modify, update, or discontinue platform features at any time. Material changes that adversely affect existing functionality will be communicated to tenants with at least 30 days' notice.

Account Registration

To use CarWashPilot, you must register with a valid email address. You are responsible for maintaining the security of your account. You must provide accurate and complete information during registration. Each account is intended for a single business entity.

Subscription Plans & Billing

CarWashPilot operates on a transaction-based pricing model. A transaction fee is charged on every payment processed through the platform via Stripe Connect, as specified in the applicable pricing plan. The current fee structure is available on our pricing page. This fee is automatically deducted before the remaining funds are transferred to the tenant's connected Stripe account. Transaction fee invoices are automatically generated and available in the tenant dashboard. All fees are net amounts. We reserve the right to change pricing with 30 days' notice to existing customers.

Payment Processing

All payment processing is handled through Stripe Connect. By using CarWashPilot, tenants agree to the Stripe Connected Account Agreement and Stripe Terms of Service. CarWashPilot is not a payment service provider and does not have access to full credit card details of end customers. Payouts to your bank account are handled by Stripe according to their payout schedule. You are responsible for ensuring your Stripe account remains in good standing. Refunds to end customers are processed by the respective tenant through their Stripe dashboard. The platform transaction fee on refunded transactions is generally not refunded, unless the refund was caused by a platform error on our part.

Invoicing

The platform provides a technical invoicing feature that enables tenants to generate invoices for bookings and subscriptions to their end customers. The tenant is solely responsible for the correct configuration of their invoice details (business name, address, VAT ID, tax rates) and for compliance with applicable tax regulations. CarWashPilot acts exclusively as a technical service provider and assumes no liability for the accuracy of invoices created by tenants.

Your Responsibilities

As a business using CarWashPilot, you are responsible for: the accuracy of your business information and service descriptions; compliance with applicable laws in your jurisdiction (including consumer protection, tax, and data protection laws); maintaining your own legal pages (Privacy Policy, Terms, Impressum) for your customers; the quality and delivery of car wash services you offer; obtaining necessary business licenses and permits.

Data & Content

You retain ownership of all data you enter into CarWashPilot (business info, customer data, service descriptions). We do not sell your data to third parties. We process your data solely to provide and improve the platform. You are the data controller for your customer data; we act as a data processor. The platform offers export features for check-in data and customer lists. Upon account termination, your data will be retained for 30 days for export and then securely deleted, unless a longer legal retention obligation applies.

Platform Availability

We aim for a minimum availability of 99.5% on a monthly basis, excluding scheduled maintenance. Scheduled maintenance windows will be announced at least 48 hours in advance via email or in-app notification. We are not liable for outages caused by force majeure, third-party service failures (e.g., Stripe, hosting provider), or circumstances beyond our reasonable control.

Intellectual Property

The CarWashPilot platform, including its design, code, and documentation, is our intellectual property. Your subscription grants you a non-exclusive, non-transferable right to use the platform for its intended purpose. You may not copy, modify, reverse-engineer, or distribute any part of the platform.

Prohibited Uses

You agree not to: use the platform for unlawful purposes; interfere with the platform's operation or security; access other users' data without authorisation; resell or sublicense access to the platform; upload malicious code or content.

Limitation of Liability

To the maximum extent permitted by law, CarWashPilot's total liability is limited to the fees you have paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits, data loss, or business interruption. This limitation does not apply to liability that cannot be excluded by law (e.g., gross negligence or wilful misconduct).

Termination

You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period. We may suspend or terminate your account for material breach of these Terms, with notice where practicable. Upon termination, your access to the platform ceases, but we retain financial records as required by law.

Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes via email at least 30 days before they take effect. Continued use of the platform after changes take effect constitutes acceptance.

Governing Law & Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany. Any disputes shall be subject to the exclusive jurisdiction of the courts of Elmshorn, Germany.
